Black money: Legitimise it by paying 15% tax, park it in India

There's some delightful news for those with Swiss bank accounts. Indians , who opted for such numbered account service, have a way to mislead anyone trying to hunt them down. For them, a new window in the tax law has flung open just when some of the doors are about to shut. The law of the land has made it possible for them to bring back the money , legitimise it by paying 15% tax, and park it in any account with a bank in India. No questions will be asked. The taxman won't harass them because it's money on which tax has been paid.

Officials at the enforcement directorate can't slap a summon because it's authorised transfer of funds from an overseas firm to a company in India through official banking channels. There are certain expenses involved as lawyers and accountants have to be hired to make the money transfer look genuine. You can't really ask your Swiss banker to send the money straightaway to your savings account with the State Bank's Santacruz branch. The man may think you have finally lost it.

There are other foolproof ways of going about with such business. A new company has to be set up in one of the tax havens, money has to be moved out from the secret numbered account to the account of the newly-formed company with another bank and then pay the amount as dividend to an Indian company. Ask your chartered accountant; he knows all about it, and even if he doesn't , he will give you the telephone number of a professional who does. Such a professional will guide you through the maze of foreign exchange and tax rules to help you bring back the money that is rightfully or wrongfully yours.

Take one step at a time: Step 1: Set up a company in Dubai. It's easier than setting up one in India : Apply for a name with Dubai authorities and submit a simple memorandum . It will cost a few lakhs and will be done in a week. You will get an address, bank account and directors pooled in from an army of 'service providers' floating around in Dubai. (In a recent seminar, one of the Dubai state officials promised all assistance to Indian companies setting up arms in UAE). An Indian firm controlled by the Swiss bankaccount holder floats the Dubai subsidiary . This new subsidiary has a single purpose: to hold the money that will move out of Switzerland to Dubai, before it travels to India.

Step 2: Now, the money lying with the Alpine bank has to be transferred to a Dubai Bank, where the newly set-up company has an account . Let's call this firm Fei Qian - the Chinese term for flying money. Since it's unlikely that any company in Dubai will carry such a name, authorities in UAE will take little time in giving the permission. Hours after the Swiss bank receives instruction , money flows out of the numbered account to Fei Qian's account in Dubai.

Fei Qian poses as a global consultant with clients across Europe , and the money that has just flown into its Dubai account are fees from these clients. Swiss banks will never say why and where they transfer funds, while Dubai survives by instructing their banks not to ask such silly questions. Step 2 is over. What follows is the last leg of the money flow - the passage to India.

Step 3: The Indian parent of Fei Qian receives the money as dividend income from its subsidiary in Dubai. The money may travel in tranches with decent intervals to avoid needless suspicion. Indians with Swiss bank accounts couldn't have asked for a better deal from New Delhi. Pay a 15% one-time tax and everything is forgotten and forgiven. Dubai has no tax. So, Fei Qian pays no tax - neither when it 'earns' the money nor when it distributes dividends to the Indian parent . The only tax that's paid is 15% of the money after it comes to India.

It's a tax rate that's 2-3 % lower than Singapore's , and half of what firms and individuals in India pay. More and more individuals are beginning to spot the beauty of the 15% tax rule. It's nothing but a backdoor amnesty scheme. A full-blown amnesty scheme, particularly calling it 'amnesty' , would have stirred a hornet's nest: bad press, hue and cry from the Opposition, public interest litigations filed by righteous individuals and embarrassing questions from Supreme Court judges.

Why turn things ugly? Lower the tax on certain inflows from abroad and let smart guys figure out the rest. What's more, once the Dubai subsidiary is up and running, the Swiss bank account holders do not have to snap their ties with the banks that have guarded their secrets for years. All they have to do is close the numbered account and let the Dubai company open a new account with the Swiss bank. The money that's not sent to India as dividend can come back to the new account in Switzerland.

If the Indian government fishes for details on certain individuals after January 1 when the now-famous Indo-Swiss treaty comes into force, Swiss banks are not bound to talk on accounts that have already been closed. Numbered accounts will be history while new accounts opened by some Dubai firms will pass off as normal corporate business. Like Dubai, Switzerland too needs our money.

India Against Corruption

“From the way the Government has accepted (our demands) ,the people of India have won!"

Okay, we all must be knowing by now about the Veteran social activist Anna Hazare’s fast unto death to press for the demand of involving civil society in formulation of the anti-graft Lokpal Bill(ombudsman). Anna Hazare announced that he will call off his four-day-old hunger strike Saturday morning, saying the government had conceded most of the demands related to a stringent Lokpal Bill to combat corruption in India.

More than 83 hours after he launched his fast in the heart of the capital, Anna Hazare told reporters and frenzied supporters : ‘From the way the government has accepted (our demands), the people of India have won !’

His campaign to exert pressure on the Government of India to enact a strong anti-corruption act as envisaged in the Jan Lokpal Bill did gain momentum in a fast rhythm and his voice was echoed all over the country through mass support including Bollywood bigwigs like actors Aamir Khan, Anupam Kher, Juhi Chawla, Diya Mirza and Ranvir Shorey, filmmaker Shekhar Kapur and Madhur Bhandarkar, actor and social activist Rahul Bose etc.

Lets have a brief, quick review at the whole histrionic episode…

1) Who is Anna Hazare ? Started his career as a driver in the Army and turned into a social activist. 2) What’s so special about him ? He built a village Ralegaon Siddhi in Ahamad Nagar district, Maharashtra 3) So what ? This village is a self-sustained model village. Energy is produced in the village itself from solar power, bio-fuel and wind mills. In 1975, it used to be a poverty clad village. Now, it is one of the richest village in India. It has become a model for self-sustained, eco-friendly & harmonic village. 4. Ok…? Anna Hazare was awarded Padma Bhushan and is a well-known figure for his social activities. 5) Really, what is he fighting for ? He is supporting a cause, the amendment of a law to curb corruption in India. 6) How can that be possible ? He is advocating for a Bil, The Lok Pal Bill (The Citizen Ombudsman Bill), that will form an autonomous authority who will make politicians (ministers), bureaucrats (IAS/IPS) accountable for their crooked deeds. 7) It’s an entirely new thing, right..? In 1972, the bill was proposed by then Law minister Mr. Shanti Bhushan. Since then it has been neglected by the politicians and some are trying to change the bill to suit thier theft (corruption). 8 ) Oh..He is going on a hunger strike for that whole thing of passing a Bill ! How can that be possible in such a short span of time ? The first thing he is asking for is that the government should come forward and announce that the bill is going to be passed. Next, they must make a joint committee to draft the Lokpal Bill including 50% government participation and 50% public participation because one can’t trust the government entirely for making such a bill which doesn’t suit them. 9) Fine, What will happen when this bill is passed ? A LokPal will be appointed at the centre, who’ll have an autonomous charge, say like the Election Commission of India. In each and every state, Lokayukta will be appointed. The job is to bring all alleged party to trial in case of corruptions within 1 year. Within 2 years, the guilty will be punished unlike, the Bofors scam or the Bhopal Gas Tragedy case, that have been going for last 25 years without any result. 10) Is he alone ? Who else is there in the fight with Anna Hazare ? Baba Ramdev, Ex. IPS Kiran Bedi, Social Activist Swami Agnivesh, RTI activist Arvind Kejriwal and many more. 11) Ok, got it. What can I do ? At least we can spread the message by putting status message, links, video, changing profile pics. We can support Anna Hazare and the cause for uprooting corruption from India. As a mark of support to Anna Hazare's movement, YOUTH INITIATIVE of Lucknow have decided to constitute a platform to bring people from all walks of life together for putting up a joint front in India's fight against corruption.

The Youth Initiative has decided to hold a demonstration on 08/04/11. It will include a day-long fast and Bike rally & Candle March in Lucknow in the evening. People from all walks of life are expected to take part in the agitation. YOUTH INITIATIVE feel that a unified front in Lucknow expressing solidarity to Anna's effort would make a larger impact at the national level.

YOUTH INITIATIVE have contacted various associations and organizations besides civil society groups and have issued an appeal to public at large to come forward and participate in the demonstration. They said that they have got positive feedback from several organizations representing lawyers, doctors, teachers, students, traders, government employees and others.

Corruption Free India

Ones again bureaucracy has shown rude to poor slums. Slum in lucknow in gomtinagar surviving since fifteen years in a land when it was far from amenities of city, which is now attracting to everyone because of its surrounding is now in the ambit of posh city. The land which can be converted in any government department or trade office or business yundertaking.

It was the shocking and almost thundering day for them when bureaucracy has come with bulldozers’, police and officials gathered them to smash their livelihoods. Poor slum not knowing their rights, illiterate & managing their food every day earning. Slum is divided into two parts; one is of Muslims community and another of Hindu community.

They are earning their hard income from the works of handicraft like stone & traditional cultural products ( dholakh aur sill ka kam). The work which is now shrinking day by day and replace by innovative products available in every corner of market. When often we are visiting, they are coming in crowed and asking for work to us, high and middle class people want to make distance from them, hesitate to talk them and not require any relationship. We are like embassy, they thinking. Anyhow of our best some of them we provide two three day work. Every night before going for sleep they pray for next morning not to face with government bulldozers. It is not only them to lost their land but also vanish from the city and means of earning.

It is not only immoral but impels them to crime. Unemployment, homeless, illiteracy and unfavorable government are the main cause for spreading crime in society. Who birth naksalwad & mauwad. First we are making them and then facing them.

First Government not developed the land and then they are taking its fruit. Where was bureau before fifteen years, why they not stop them then? This time they are very clever to have land without any compensation etc., they not want to expose the issue, bureau has prepared well this time. And we are sure they takeover land because this is also the same situation when they can easily face illiterate & poor slum. And ultimately society will face looming threat of crime.

Save poor, save crime.
